Singaraja-Anti-Corruption Study Center, Department of Law and Citizenship, Faculty of Law and Social Sciences, Ganesha Education University (Undiksha) held a Focus Group Discussion on the second (FGD II).teleconference at Puri Saron Hotel, Buleleng, Tuesday (13/10/2020). The FGD discussed the Study of Trial Decisions and the Utilization of Corruption Crime Trial (Tipikor) Results for 2019 cases. This activity was in collaboration with the Anti-Corruption Eradication Commission (KPK). This is a form of participation by academics, practitioners, students, and the public to identify obstacles in the process of determining decisions in corruption cases as recommendations that can be used in the process of determining decisions in similar cases in the future.
This FGD was attended by a team studying the results of the recording of this trial of 6 people, chaired by Dr. Dewa Gede Sudika Mangku, S.H., LL.M, Ni Putu Rai Yuliartini, S.H., M.H., as secretary, Dr. Made Sugi Hartono., S.H., M.H., as a member, and I Kadek Darma Santosa, S.H., as a member. And 2 reviewers, Prof. Dr. I Wayan Lasmawan, M.Pd., and Prof. Dr. Sukadi, M.Pd., M.Ed., from academics. As well as 3 practitioners, including I Kadek Dony Hartawan, S.H., M.Kn., I Nyoman Sardana, S.H., M.H., and Dr. M. Wiman Wibisana, S.H., M.H.
This activity was also attended virtually by the Corruption Eradication Commission, namely the Director of Prosecution of the Corruption Eradication Commission, who was represented by Lie Putra Setiawan, S.H., M.H, and the Observer Team of the Corruption Eradication Commission of the Republic of Indonesia. “This second FGD activity is essentially the presentation of the background, aims, and objectives of the review of the Corruption Case decision, position case, and presentation of the results of the First FGD,” said Dr. Dewa Gede Sudika Mangku, S.H., LL.M who is also the Head of the Undiksha Law and Citizenship Department.
This FGD has produced views from both the review team as academics and views from practitioners regarding the decision in case number 36/PID.SUS.TPK/2019/PN.MTR is a form of control and supervision of the legal products that have been issued. “This activity is a form of supervision of the legal products produced and the proceedings by legal officials, including legal practitioners. “This supervision is carried out with the assumption that many legal products and legal processes are running defiantly, both materially and formally, so a separate study is needed on the products produced by the authorities,” concluded Dewa Mangku.
Meanwhile, I Kadek Dony Hartawan, S.H., M.Kn., who works as a Notary and PPAT who had the opportunity to attend at that time, hopes that this FGD will be able to provide a study of the decisions on corruption cases using scientific principles to produce recommendations that can be used in the process of determining case decisions. similar going forward. There are also great hopes for this FGD to produce a formula to prevent corruption in the younger generation. “FGD activities or something like this must continue to be carried out and developed, it is not enough to just focus on this activity, so that through this kind of activity it is hoped that it will be able to support increased independence, transparency and accountability of the judiciary,” he said.
On the other hand, I Nyoman Sardana, S.H., M.H., who works as an advocate, said that this FGD is a forum for viewing and analyzing how the judicial process is capable or can be said to fulfill the elements of certainty, benefit, and justice in society. “This FGD activity is basically to encourage and empower the participation of academics and the public so that they can be further involved in questioning the process of a case and the decision on that case which is considered controversial and hurts the community’s sense of justice,” he said. Apart from academics and legal practitioners, this FGD was also attended by students who recorded the trial and were members of the Anti-Corruption Study Center, Undiksha Department of Law and Citizenship.
