Singaraja- The Law and Citizenship Department Student Association (HMJ), Faculty of Law and Social Sciences, Ganesha Education University held a general discussion virtual, Friday (17/7/2020). This latest work program carries the theme “Political, Legal, Ideological and Constitutional Issues during the Covid-19 Pandemic: Pros and Cons of the HIP Bill”.
This discussion presented speakers I Wayan Budiarta, S.Pd., M.Pd., and Putu Ronny Angga Mahendra, S.Pd., M.Pd., Chair of the Law and Citizenship Department, Dr. Dewa Gede Sudika Mangku, S.H., LL.M., who opened and closed the activity, appreciated the implementation of this activity because it provided new understanding for students amid the Covid-19 pandemic. “Various aspects of life have been affected by the prolonged pandemic. However, HMJ Law and Citizenship’s intention has not diminished to provide various knowledge to all students with this general discussion via the Google Meet application. “We appreciate this,” he explained.
In this general discussion activity, we discussed hot issues that had emerged as if trying to cover up a pandemic phenomenon that was currently hitting Indonesia. A draft law entitled Pancasila Ideology Policy has become a heated debate among all circles of elite politics to the lower classes of society. The trigger for this problem started from several things that were considered inappropriate and had the potential to cause problems as a result of the launch of the draft Law on Pancasila Ideology Policy. During the discussion, it was assessed that there were several problems. First, as we all know, Pancasila is the source of all legal sources that exist in Indonesia to date. With the draft to create a Law on the Ideology of Pancasila, it will result in Pancasila’s position being below Pancasila.
Second, the exclusion of TAP MPRS NO.XXV/1966 concerning the dissolution of the Indonesian Communist Party, the declaration that the Indonesian Communist Party is a prohibited organization throughout the territory of the Republic of Indonesia, and the prohibition of any activities to spread or develop Communist/Marxist-Leninist ideology or teachings in the draft The Pancasila Ideology Policy Law is impressive and very likely will open up opportunities for Communist organizations to revive in Indonesia.
Thirdly, the drafting of the Pancasila Ideological Policy Draft Law which is intended as a policy or to direct will create chaos in the order of state-order norms. Fourth, as it is known, in article 7 of the draft Law on the Ideological Direction of Pancasila, which consists of 3 verses, in which verse 2 and verse 3 are currently in the public spotlight. Fifth, Pancasila, which has become the source of all legal sources in Indonesia until now, is certainly not appropriate if Pancasila is reduced to a Law. Don’t let Pancasila, whose purpose is to unite Indonesian society, turn into a divisive one for Indonesian society. (rls)
